Apprentice Serg Lisnyy Suspended Over Calming Influence Ride

RACE 4: Sydney City Toyota Handicap 1300m:
An inquiry was opened into App. S Lisnyy’s handling of third placegetter, Calming Influence, and in particular the amount of use made of that filly in the early and middle stages. Mr L Prior, representing trainer Mr C Waller, stated the instructions had been to lead on Calming Influence and endeavour to lead by a margin so that there was no horse positioned to place pressure to the outside of Calming Influence. App. Lisnyy stated that he rode his mount along to cross and to assume a clear lead, but in retrospect believed he had erred in pushing his mount early, as it then refused to come back under him in the middle stages. App. Lisnyy conceded that he had gone too fast and although he contended his mount overraced, he also sought to establish clear ascendancy over the second placed horse, Miniature. Mr Prior stated, whilst the intention had been to lead and dictate, Calming Influence had gone too quickly and, as a result, did not finish the race off, weakening to finish in third position. The inquiry was adjourned, whereby App. Lisnyy will be asked to attend in the presence of his master, trainer Mr D Payne.

Apprentice Serg Lisnyy Suspended Over Calming Influence Ride

Racing NSW Stewards today concluded an inquiry into apprentice jockey Serg Lisnyy’s riding of the third placegetter, Calming Influence (beaten 4-½ lengths), in the Sydney City Toyota Handicap (1300m) on the Kensington Track on Saturday, 23rd November 2013.

Evidence was today taken from David Payne, master of Serg Lisnyy, and further evidence was taken from Serg Lisnyy.

Racing NSW Betting Steward/Form Analyst, Terry Griffin, presented sectional time summaries to the inquiry which indicated that Calming Influence travelled through the section from the start to the 600-metres in 1.75 seconds (10 lengths) faster than the average for the ten fastest times from the 1300m start to the 600m in the past 13 years on the Kensington Track.

Further, that between the start and the 800m, Calming Influence went 10.4 lengths and between the 800m and the 400m Calming Influence went 10.1 lengths above the benchmark for good/dead tracks for the 1300m races on the Kensington Track (taken from 256 records).

Assisted by David Payne, Serg Lisnyy today pleaded guilty to a breach of Australian Rule of Racing AR135(b).

The details of the charge being that apprentice jockey Serg Lisnyy did fail to take all reasonable and permissible measures throughout the Sydney City Toyota Handicap (1300m) conducted on the Kensington Track on Saturday, 23rd November 2013, to give third placegetter Calming Influence full opportunity to win or obtain the best possible place in the field in that he:-

• After riding his mount along to cross to clearly lead from barrier six, Serg Lisnyy, from the 1100-metre mark failed to make any concerted effort to restrain Calming Influence and set a lesser pace when it was reasonable and permissible for him to do so which resulted in Calming Influence setting a pace between the start and the 800-metre mark which was so fast that it was detrimental to that horses chances of winning or finishing in the best possible place in the field.

• After setting an extremely fast pace from the start to the 800-metres Serg Lisnyy then between the 800-metres and the 500-metres allowed Calming Influence to continue to set a pace so fast that it was detrimental to that fillies chance of winning or finishing in the best possible place, when it was reasonable and permissible for him to have restrained his mount and to have set a lesser pace.

In assessing penalty, Stewards took into account Serg Lisnyy’s guilty plea and his status as an apprentice, albeit an experienced apprentice jockey at 28 years of age with over 1000 rides and 120 winners.

A penalty of one month’s suspension of jockey Lisnyy’s permit to ride in races was applied, to be served cumulatively with a careless riding suspension issued at Rosehill Gardens on the 30th November 2013. Consequently, Serg Lisnyy’s permit to ride will be suspended from Sunday, 8th December 2013 and he can resume riding on Wednesday, 15th January 2014. He was advised of his rights of appeal.

Serg Lisnyy was advised that in the interim along with adhering to education provided for him by his master Mr Payne, he should continue to take avail of the guidance of Racing NSW Riding Skills Panel members, particularly as it relates to pace in races
