Ray Murrihy와의 첫만남, 반갑게 맞아주었다. ARC에서 오택봉 차장님을 만난것도 이야기해면서 여러가지를 가르쳐주려는 모습을 보여주어 고마웠다.

오늘의 Appeal case는 약물검출에 관한 것이었다. 조교사 Mr. Greg McFarlane의 말인 Biggietupac이 2012.3.7 경주 후 요검사에서 3-methoxytyramine이 허용농도 이상으로 검출되어 4개월의 suspension 처분을 받았고 이에 대한 appeal이 이루어졌다. Appeal Panel은 나이가 지긋한 3명이었으며 chairman은 Mr. J Hiatt였다. 조교사는 변호사를 통해 어필은 진행하였다. 순서는 먼저 deputy chairman인 Greg Rudolph가 전체적으로 심의를 한 내용을 시간대별로 설명을 하였고 제재결정을 내린 근거들을 조목조목 설명하였다. 이후 변호사은 자신의 고객인 조교사를 항변하며 제재가 과하다는 근거들을 나열하였다.

일정시간 정회 후 오후 2시에 appeal panel들의 결과발표가 있었다. 결론적으로는 재결위원의 판단이 옳았으며 appeal은 받아들여지지 않는다는 것이었다. 결과 발표 후 조교사의 변호사는 또 다른 appeal방법을 확인하여 아마 추가적인 항소가 이루어질 것 같았다.

Appeal By Licensed Trainer Greg McFarlane Dismissed

Please be advised an appeal by licensed trainer Greg McFarlane was dismissed today by the Racing NSW Appeal Panel.

Mr McFarlane appealed against a 4-month suspension imposed by Stewards and incurred under AR178 after Biggietupac finished 3rd in the F&M Benchmark 75 Handicap at Wyong Racecourse on 7th March 2012.

Mr McFarlane’s suspension commences today, 10th August 2012 and expires on 10th December 2012.

Mr McFarlane has lodged a further appeal to the Racing Appeals Tribunal and has applied for a stay of proceedings. The Tribunal is currently considering this application.
