Stewards Report On Running & Handling Of Astronomer

Racing NSW Stewards continued their inquiries from the 27th July and 3rd August, 2102, into the running and handling of Astronomer in the Timber Trader at Minumurra Stud Maiden Handicap over 1000 metres conducted on the 16th June 2012 at the Goulburn & District Racing Club meeting.

Charges emanating from those proceedings were issued in writing on Friday 24th August, 2012.

Licensed jockey Mathew Cahill, represented by Mr Noel Davis, of counsel, assisted by solicitor, Mr Jonathon Davis, was found guilty of a charge under AR135 (a) & (c) with not allowing a horse to race on its merits, the details of the charge being that when licensed jockey Mathew Cahill rode third placegetter Astronomer in the Timber Trader at Minumurra Stud Maiden Handicap, 1000 metres, at the Goulburn and District Racing Club meeting on the 16th June 2012, he did not allow that horse to race on its merits in that:-

1) Upon jumping away he restrained Astronomer causing that horse to miss the start and lose ground.

2) Between the start and the 400 metres, he restrained Astronomer and failed to improve his position onto the back of the leader No Cash For Teddy, the horse he remained trailing by three and a half lengths.

3) Between the 400 metres and approaching the 200 metres when at all times there was a clear run for Astronomer to improve into between No Cash For Teddy and Winning Angel, he positioned Astronomer on the rail some three to three and a half lengths behind No Cash For Teddy and continued to restrain his mount and failed to ride his mount with vigour to improve his position.

4) Approaching the 200 metres when Astronomer shifted away from the rails he directed Astronomer back to the rails thereby causing Astronomer to again be positioned on the back of No Cash For Teddy where there was no run available and Astronomer therefore being unable to improve its position.

5) Near the 100 metres when Astronomer shifted away from the rails he allowed Astronomer to drift back to the rails, thereby causing Astronomer to again be positioned on the back of No Cash For Teddy where there was no opportunity to improve your position.

6) At all times over the final 200 metres, he failed to ride his mount out with an acceptable degree of vigour.

Mathew Cahill was disqualified for a period of 12 months to commence immediately and to expire on 11th September, 2013, when he may reapply for a licence.

Part-owner of Astronomer, Mr Guy Orbell, who is also licensed as a bookmaker, was found guilty of a charge under AR135 (a) & (c), the details of the charge being that as a part owner of the racehorse Astronomer, Mr Orbell was a party to licensed jockey Mathew Cahill committing a breach of AR 135 (a) in that he entered into an arrangement with Mathew Cahill for him not to allow Astronomer to race on its merits in Race 2, the Timber Trader at Minumurra Stud Maiden Handicap ,1000 metres, at the Goulburn and District Racing Club meeting on the 16th June 2012.

Mr Orbell was disqualified for a period of 12 months to commence immediately and to expire on 11th September, 2013, when he may reapply for a licence.

Mr Orbell pleaded guilty to a charge under AR175B (3), the details of the charge being that, as a part owner of Astronomer, he did lay the horse Astronomer, when it competed in Race 2, the Timber Trader at Minumurra Stud Maiden Handicap, 1000 metres at Goulburn and District Racing Club on Saturday 16th June, 2012, by way of transactions on the betting exchange, Betfair.

For this offence, Mr Orbell was disqualified for a period of 6 months to be served concurrently with the penalty imposed for the breach of AR 135 (a) and (c), so as to expire on 11th March, 2013.

Mr Orbell also pleaded guilty to a charge under AR175 (gg), the details of the charge being that he did make a misleading declaration in that, following a request in for all bets or lays placed by him or on his behalf, he failed to declare that he had laid Astronomer on betting exchange, Betfair.

For this offence, Mr Orbell was also disqualified for a period of 6 months to be served concurrently with the penalties imposed for the breach of AR 135 (a) and (c), and the breach of AR175 B(3),so as to expire on 11th March, 2013.

Licensed Bookmaker Mr Richard Knight, represented by Mr John Greenhill SC, was found guilty of an improper action under AR 175(a), the improper action being that, whilst fielding at the Walgett Jockey Club Race meeting of the 16th June 2012, he had prior knowledge that Astronomer would not be permitted to race on its merits in the Timber Trader at Minumurra Stud Maiden Handicap at the Goulburn and District Racing Club meeting that day and that as a consequence of that knowledge, he laid Astronomer on Betfair to lose in that event.

For this offence, Mr Knight was disqualified for a period of 6 months to commence immediately and to expire on 11th March, 2013, on which day he may reapply for a licence.

Mr Knight pleaded guilty to a charge under LR 97 (2), the details of the charge being that Mr Knight, at the Walgett Race Meeting on Saturday the 16th June 2012, did without the permission of the Stewards, use a portable telephone that had not been approved under an authority issued by the Minister of Gaming and Racing, to make and receive phone calls.

For this offence Mr Knight was fined $1000.

Mr Knight also pleaded guilty to a charge under LR 97A, the details of the charge being that, at the Walgett Race Meeting on Saturday the 16th July 2012, Mr Knight did have in his possession and use a device which permitted internet access that had not been approved by Racing NSW, namely his personal computer, which he used to lay Astronomer on betting exchange Betfair.

For this offence Mr Knight was fined $500

Furthermore, Mr Knight pleaded guilty to a charge under LR 97A (3), the details of the charge being that Mr Knight did fail to record in his ledger and identify as an electronic internet bet, details of the transactions made on his account with betting exchange Betfair on Goulburn Race 2, the Timber Trader at Minumurra Stud Maiden Handicap at the Goulburn and District Racing when fielding at Walgett race meeting on Saturday 16th June 2012.

For this offence, Mr Knight was fined $500.

Part-owner Mr Robert Grynberg was found guilty of a charge under AR175 (l), the details of the charge being that Mr. Robert Grynberg was a party to fellow part-owner Mr. Guy Orbell committing a breach of the rules, namely for Mr Orbell to lay Astronomer in Race 2 the Timber Trader at Minumurra Stud Maiden Handicap at the Goulburn and District Racing Club on 16 June 2012, on the betting exchange Betfair, such act of Mr. Orbell being in breach of AR175B(3), in that he transferred an amount of money into a Betfair account, which he operated in conjunction with Mr. Orbell.

For this offence Mr Grynberg was fined $2000.

Mr Grynberg was also found guilty to a charge under AR 175 (gg), the details of the charge being that Mr. Grynberg did make a misleading declaration in correspondence dated 26th June, 2012, in response from a request from the Stewards in correspondence, for ‘any and all telephone records and/or communications from a phone owned and/or operated by him.

For this offence, Mr Grynberg was fined $1000.

Licensed bookmaker Mr Ken Orbell pleaded guilty to a charge under LR 91(j), the details of the charge being that Mr Ken Orbell did fail to record in his betting sheets, details of bets placed on Astronomer in Race 2, the Timber Trader at Minumurra Stud Maiden Handicap at the Goulburn and District Racing Club meeting on 16 June, 2012.

For this offence Mr Orbell was fined $500.

A charge issued against licensed bookmaker Mr Ken Orbell under LR 97 (2), being that Mr Orbell did, at the Walgett race meeting on Saturday 16th June, 2012, outside of the terms for permission given by the Stewards on the day, have in his possession and use a portable telephone that had not been approved under an authority issued by the Minister for Gaming and Racing to receive and make calls, was not sustained.

All parties were advised of their rights of appeal.
