오늘은 Appeal Case가 두건이 진행되었다.

재심의 첫번째 단계인 Appeal Panel들이 이건에 대해 심의를 하였다.

 

James Mcdonald의 Careless Riding에 대해 재심장면

 

첫번째는 James Mcdonald의 Careless Riding에 대한 재심건이었다. 저번주 NSW에서 가장 큰 경주인 Golden Slipper 경주에서 경주초반 안으로 진로를 변경하여 안쪽에 있던 마필에게 피해를 준 상황이었다. 우선 그날 Steward Report는 아래와 같다.

J McDonald, rider of Romantic Moon, pleaded guilty to a charge of careless riding in that he applied pressure to Sidestep approaching the first turn, resulting in that runner being taken in onto the heels of Overreach and having to be checked. J McDonald’s licence to ride in races was suspended for a period to commence on Sunday, 14 April 2013 and to expire on Sunday, 28 April 2013, on which day he may ride.

Appeal에 대한 재심은 법원의 심리절차와 비슷하다. 우선 Panel은 Steward가 처벌을 내린 사유와 관련된 증거들을 다시 듣는 Re-hearing과정을 거친다. 이는 Panel들이 해당 사안에 대해 좀더 객관적이고 공정한 판단을 하게 하기 위함이다. 해당일 Chairman of Steward였던 Ray Murrihy가 Steward Footage를 플레이해가며 기수가 진로변경을 한 상황, 피해마가 피해를 입은 장면, 기수들의 관련된 진술, Tower에서 관찰했던 Steward의 진술 등을 일반 재판의 검찰에 입장에서 Panel에게 설명을 한다.

바로 이어서 Applicant인 James Mcdonald의 의견을 듣는다. 보통 기수들은 변호사(Solicitor)를 고용하여 변호사들이 기수의 진술을 대변한다. 이번건에 대해서는 해당 기수가 안으로 들어가 피해가 발생했다기 보다는 선두마였던 Overreach가 페이스를 줄여 뒤에 있던 말이 제어를 할 수 밖에 없단 상황이었고, 이전 제재건에 비해 제재수준이 강하다는 것이었다. Steward는 큰 경주에 대해서는 좀 더 큰 제재를 하고 있고 제재수준은 Template에 의거하여 정하고 있다고 반박하였다.

심의결과는 Steward의 원제재를 인정하고 Appeal에 대해서는 Dismiss하는 것이었다. 흥미로웠던 점은 판단을 내린 중요한 근거 중 하나는 Tower에서 쌍안경으로 관찰했던 Steward의 진술이었다. 화면상의 증거도 중요하지만 현장에서 Steward가 실제로 보고 느꼈던 점을 진술한 내용이 중요하게 생각되었다. 다시한번 steward가 Tower로 나가 경주를 관찰하고, 증거를 제시하는게 중요하다는 걸 인식하는 계기가 되었다.

Licensed jockey James McDonald lodged an appeal against the severity of the penalty of a two-week suspension imposed on him by Racing NSW Stewards at Rosehill Gardens on Saturday, 6 April 2013. James McDonald rode Romantic Moon in Race 7 (Tooheys New Golden Slipper) and was charged with careless riding under AR137(a). He was suspended from 14 March 2013 to 28 March 2013. The appeal was set down for Friday, 12th April 2013 and was dismissed. The penalty of 14 days suspension was confirmed. The suspension will commence on 14 April 2013 and conclude of 28 April 2013, on which day he may ride. The appeal deposit was forfeited

 

두번째는 기수 에이전트인 Lisa Mcgee에 대한 심의였다. 이전에 자신이 RISA에 접근할 수 있는 비밀번호를 다른 사람에게 알려준 사안에 대해 Inquiry를 열였지만 연락을 받고도 출석하지 않았고 관련된 증거도 제출하지 않았었다. 결국은 심의결과 Disqualification 12 month와 과태금 1,000달러에 처분을 받은 것에 대해 처분수준이 과하다는 Appeal이었다. 이번에도 Steward의 진술과 Applicant의 진술이 재청취되었다. 심의결과는 12개월을 8개월로 낮추는 것이었다.

1년간 Appeal case를 봐온 바로는 처분에 대해서는 대부분 Dismiss되고 처분수준에 대해서는 보통 받아들여져 낮춰주는 것 같다. Panel들의 대부분이 법조계인사들이고 Natural Justice를 중시하는 분위기로 처분에 대해 감형하는 경우가 많았다.

Licensed riders' agent Lisa McGee lodged an appeal with the Racing NSW Appeal Panel against conviction and penalty following her disqualification for 12 months by Racing NSW Stewards, acting under AR175 (g) and 175 (f). A Stay of Proceedings was granted until the appeal which was held on Friday, 12th April 2013. The appeal was dismissed but the penalty was varied to:-
* AR175(q) Improper Conduct. 6 months disqualification varied to 5 months disqualification to commence 13 April 2013 to 12 September 2013
* AR175(f) Fail to attend Stewards Inquiry. 6 months disqualification varied to 3 months disqualification to commence 13 September 2013 to 12 December 2013
* AR 175(p) Fail to comply with a direction of an official. $1,000 fine confirmed, no variation. The appeal deposit(s) forfeited.
