Licensed Apprentice Jenny Duggan Suspended For A Month

Racing NSW Stewards today concluded an inquiry opened on 13 October 2012 at Kembla Grange Racecourse into the handling of Lady Lonhro in the Kembla Grange Cup Benchmark 65 Handicap.

On 13 October 2012, evidence was taken from apprentice jockey Ms Jenny Duggan, rider of Lady Lonhro, and trainer Ms Diane Poidevin-Laine, who represented Ms Tara Laine, trainer of Lady Lonhro.

On Tuesday, 30 October 2012, evidence was taken from trainer Ms Tara Laine and trainer Adam Duggan, master of apprentice Ms Jenny Duggan, and further evidence was taken from Ms Poidevin-Laine and apprentice Duggan.

At today’s hearing evidence was taken from apprentice Jenny Duggan’s manager, Ben Duggan, and further evidence was taken from trainer Adam Duggan and apprentice Jenny Duggan, who was assisted by Legal Practitioner, Wayne Pasterfield.

Apprentice Duggan was found guilty of the following charge under AR135(b);

AR135(b) The rider of every horse shall take all reasonable and permissible measures throughout the race to ensure that his/her horse is given full opportunity to win or to obtain the best possible place in the field.

The details of the charge being that when apprentice jockey Jenny Duggan, rode 6th placegetter Lady Lohnro in Race 6 (Benchmark 65 Handicap, 2000m) at Kembla Grange Racecourse on 13 October 2012, she failed to take all reasonable and permissible measures throughout the race to give Lady Lonhro full opportunity to win or obtain the best possible place in the field in that:-

1) Upon trailing Kukri into the straight in last position, she positioned Lady Lonhro on straightening between Kukri and Flying Distraction when at all relevant times it was reasonable and permissible for her to have directed Lady Lonhro to the outside of Flying Distraction whereby Lady Lonhro would have been afforded an uninterrupted run and whereby she would have been able to fully test her mount in the home straight.

2) Between the 400 metres and the 275 metres on Lady Lonhro, she remained positioned racing between Kukri and Flying Distraction where there was insufficient room at all relevant times to improve, when it was reasonable and permissible for her to have directed Lady Lonhro to the outside of Flying Distraction whereby Lady Lonhro would have been afforded an uninterrupted run and whereby she would have been able to fully test her mount in the home straight.

3) When Kukri shifted out in advance of her near the 275 metres, she positioned Lady Lonhro on the back of Kukri for some 60 metres whereby Lady Lonhro was unable to improve when at all relevant times it was reasonable and permissible for her to have directed Lady Lonhro to the outside of Flying Distraction whereby Lady Lonhro would have been afforded an uninterrupted run and whereby she would have been able to fully test her mount in the home straight.

4) As a consequence of her actions between the entrance to the straight and until approaching the 200 metres in failing to direct Lady Lonhro to the outside of Flying Distraction, Lady Lonhro was then positioned over the final 200 metres in restricted room between Kukri and Fair Nation and on the back of Speed Queen whereby Lady Lonhro became awkwardly positioned close to the heels of Speed Queen near the 50m and as a consequence could not be fully tested for the remainder of the race.

Racing NSW Stewards issued a one month suspension of apprentice Duggan’s permit to ride in races to commence on Thursday, 6 December 2012, at the expiration of a careless riding suspension incurred at the Rosehill Gardens race meeting on Saturday, 17 November 2012, and to expire on Sunday, 6 January 2013, on which day she may ride.

Apprentice Duggan was advised of her appeal rights.

 

상기 내용은 2012년 10월 13일에 있었던 사안에 대한 심의결과이다. 심의내용과 결과는 읽어보면 이해가 가는 부분이지만 내가 기록하고자 하는 것은 그 과정이다.

우리나라에서는 경마일에 모든 심의를 결론내고자 하며 심지여 많은 논의과 고민이 필요한 경주전개에 대한 심의도 그날 처분을 내린다.

하지만 호주에서는 경주전개에 대한 심의를 수차례 반복하고 관련된 기수진술과 증거들을 최대한 많이 수집한다.

 

이렇게 함으로써 얻어지는 것들은 아래와 같다.

1. 심의를 세밀하게 할 수 있어 더 많은 증거들이 수집되고 따라서 심의결과에 대한 신뢰도가 제고된다.

2. 언론이나 경마팬들도 심의과정 및 심의결과에 대해 관심이 집중된다.

3. 심의 당사자들의 압박감이 높아진다.

 

우리나라도 경주전개에 관해서는 좀 더 심층적으로 기간을 두고 심의를 하는 것이 필요하다고 생각된다.
